You can apply for ILR as a Bereaved Partner if your partner has died and you were the partner of a British citizen or settled person in the UK.

The term "settled person" refers to someone who has the right to live in the United Kingdom without any time restrictions. This status is often referred to as “Indefinite Leave to Remain (ILR)”, “pre-settled status or settled status”, or “Permanent Residency”.

Once you obtain ILR, you can enjoy many benefits, such as the ability to work and study without restrictions and the possibility of applying for British citizenship after a specified period.

Requirements for indefinite leave to remain as a bereaved partner

To qualify for ILR as a Bereaved Partner, you typically need to meet the following criteria:

  • Relationship: You must have been the partner of a British citizen, or a person settled in the UK (having ILR or settled status) at the time of their death. The relationship should have been genuine and subsisting at the time of their death.
  • Residence: You must have been living in the UK with your partner at the time of their death.
  • Permission to Stay in the UK: You must have permission to stay in the UK as a spouse, unmarried partner, registered civil partner or same-sex partner of a British citizen or a person settled in the UK.

You do not need to take the Life in the UK Test or prove your English language skills.

You must meet all other requirements depending on your personal circumstances. It is advisable to consult with an immigration solicitor for the eligibility assessment.

What documents are required for ILR as a bereaved partner?

You must provide the following documents:

  • Current valid passport or travel document to prove your identity
  • Biometric residence permit (BRP)
  • Death certificate of your partner
  • Proof of your relationship such as a marriage certificate
  • Proof that you and your partner were living together

Above is a general list of documents. You might need to provide additional documents depending on your circumstances. Get in touch with our highly experienced immigration solicitors in London to get a comprehensive list of supporting documents for your ILR application.

When to apply for ILR as a bereaved partner?

You can apply for Indefinite Leave to Remain (ILR) at any time after the death of your partner but before the expiry of your current visa. You do not have to wait until your current visa expires.

You must apply online, and you need to be in the UK when you apply.

ILR application processing time

ILR applications usually take between 3 to 6 months if applied using the standard service. However, it may take longer if your case is complex.

Super priority service for ILR

You may be able to choose "super priority service" to apply for ILR. By using "super priority service" you will get a faster decision within 24 hours (usually by the end of the next working day). You'll need to pay £800 in addition to the ILR application fee.
